Banana Editor Terms of Service

These Terms of Service ("Terms") govern your access to and use of Banana Editor ("Banana Editor", "we", "our", or "us"), including the AI image editing workspace, demos, APIs, and related sites located at bananaeditor.art (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

• Minimum age: You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. Accounts for enterprise clients may require additional verification.
• Account registration: Provide accurate and complete information. You are responsible for maintaining the confidentiality of login credentials and for all activities under your account.
• Workspaces and invitations: If you join a team or organization, your access may be managed by a workspace administrator who can view, modify, or remove your permissions.

2. Service Description

Banana Editor offers AI-powered tooling for subject-consistent editing, multi-asset compositing, lighting control, and related features. We may update or discontinue features at any time. Access to specific models (such as Nano Banana, Flux, or Qwen) can depend on plan level, usage caps, or regional restrictions.

3. Licenses and Ownership

• Your content: You retain ownership of images, prompts, and other assets you upload or generate. You grant Banana Editor a worldwide, royalty-free license to host, process, and display this content solely to operate the Service and comply with legal obligations.
• Generated outputs: Subject to third-party licenses for underlying models, we assign you the rights we receive in AI-generated outputs, except where prohibited by law or model terms. You are responsible for ensuring your outputs comply with applicable regulations and do not infringe others' rights.
• Banana Editor IP: All platform technology, documentation, brand assets, and proprietary models remain the property of Banana Editor and its licensors. No intellectual property rights are transferred except as expressly stated in these Terms.

4. Acceptable Use

You agree not to:

• violate applicable laws, regulations, or third-party rights;
• attempt to reverse engineer, decompile, or extract model weights or source code;
• upload or generate content that is unlawful, defamatory, hateful, or otherwise prohibited by our content policies;
• interfere with, damage, or disrupt the Service, including through automated scraping, rate manipulation, or denial-of-service attacks;
• resell or offer the Service on a white-label basis without written permission.

We may monitor usage for abuse, quality control, and to improve the Service. Violations can result in suspension or termination.

5. Usage of AI Providers

Banana Editor routes jobs to multiple AI providers to deliver consistent quality. By using the Service, you authorize us to transfer your prompts, assets, and metadata to these providers subject to contractual safeguards. Providers may update their acceptable use rules; we will notify you when changes affect your usage.

6. Credits, Plans, and Payments

• Plans: The Service is available via free trials, credit bundles, subscriptions, or enterprise agreements. Plan benefits, quotas, and pricing are described on bananaeditor.art/pricing.
• Billing: Payments are processed by third parties (e.g., Stripe). You authorize Banana Editor to charge the payment method on file for recurring fees and usage overages.
• Refunds: Except where required by law or stated otherwise in a specific plan, purchases are non-refundable.
• Taxes: You are responsible for applicable taxes, duties, or withholding required by your jurisdiction.

7. Termination and Suspension

We may suspend or terminate access immediately if you breach these Terms, engage in fraudulent or abusive behavior, or if continuing access would create legal or security risk. You may terminate at any time by closing your account. Sections that by nature should survive termination (e.g., ownership, indemnity, liability limits) will continue to apply.

8. Confidentiality

Where you receive access to beta features, private documentation, or non-public communications, you agree to keep such information confidential unless Banana Editor authorizes disclosure.

9. Privacy

Our Privacy Policy describes how we collect and use personal data. By using the Service, you also agree to the Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BANANA EDITOR DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. MODEL OUTPUTS MAY BE IMPERFECT, AND RESULTS CAN VARY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BANANA EDITOR, ITS AFFILIATES, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO BANANA EDITOR DURING THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

12. Indemnification

You agree to indemnify and hold Banana Editor, its affiliates, officers, employees, and agents harmless from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute will be resolved through binding arbitration in Delaware under the American Arbitration Association rules, except that either party may seek injunctive relief in a competent court to protect intellectual property or confidential information.

14. Changes to the Terms

We may update these Terms to reflect product changes or legal requirements. When we make material updates, we will provide notice via the Service or email. Continued use after the effective date constitutes acceptance of the updated Terms.
